These terms govern your use of the quivi.com marketing website and the contact / demo flows it offers. Separate Master Service Agreements govern the Quivi product (Backoffice, POS, Guests) once you become a customer.
By using the site, you agree to these terms. If you don't agree, please don't use the site.
1. Service description & operator identity #
quivi.com is operated by Binómio Vitamínico - Unipessoal, Lda, trading as "Quivi", a company registered in Portugal under NIF 518331938, with registered office at Rua do Barreiro, N.º 300, Módulo 0, 4470-573 Maia, Portugal.
The quivi.com website provides information about the Quivi platform, payment rates, and hardware bundles, and offers contact and book-demo forms that route to the Quivi sales team. No purchase, order, or payment is completed on this website; pricing and payment terms are agreed and set up as part of your signed Master Service Agreement.
Pricing shown on the site (packs, monthly amounts, payment rates) reflects current commercial offers. Final pricing is subject to a signed agreement and your venue's specific configuration.
2. Account & access #
The marketing website does not require an account. The Quivi product (separate from this site) requires a merchant account, which is governed by the Quivi MSA.
If you submit a form, you confirm the information is accurate to the best of your knowledge and that you have authority to share it on behalf of any company you represent.
Any personal data you submit through these forms — such as your name, company, and contact details — is processed by Binómio Vitamínico - Unipessoal, Lda, as data controller, solely to respond to your enquiry and manage our commercial relationship with you. We do not use it for any other purpose without your consent. You can exercise your data protection rights, or ask any question about this processing, by writing to [email protected].
3. Pricing & payment #
Prices on this site are quoted excluding sales tax, in US dollars, for the United States market unless explicitly noted otherwise. Sales tax is added at the rate applicable in your jurisdiction.
Hardware retail prices reflect current sourcing costs and may change. We commit to the price quoted at the time you sign your agreement, not the price displayed on the site at any other time.
Payment processing rates derive from our agreement with our payments partner (Paybyrd). Any change to wholesale rates may be reflected in our retail rates with reasonable notice.
Pay-as-you-go has no fixed monthly software fee. Instead, a percentage of the value of each card payment routed through Quivi is retained as the payment processing fee. The applicable percentage, and any minimum monthly commission, are set out at https://quivi.com/pricing and confirmed in your signed Master Service Agreement, which prevails over this page.
4. Subscription & cancellation (covered in MSA) #
All-In subscriptions cancel monthly with hardware return. Lease-to-own commits for 24 months and the hardware becomes yours afterwards. Own + Subscribe has no commitment beyond the monthly software fee. Pay-as-you-go has no monthly fee but requires exclusive routing of card payments through Quivi while active.
Specific cancellation, refund, and termination terms are in the Master Service Agreement signed with us, which supersedes anything written here.
5. Acceptable use #
Don't use the marketing site or the forms it offers to send abuse, spam, malware, or materially false information. Don't try to compromise the security of the site or its infrastructure.
Automated submissions are blocked by rate-limiting. Repeated abuse may result in your IP being blocked from the site.
6. Intellectual property #
All content on quivi.com — copy, branding, design, code, demos — is owned by Quivi or licensed to us. You may share links to public pages and quote short excerpts with attribution. You may not copy substantial portions, scrape the site, or build derivative works without written permission.
Customer logos, where shown, are used with permission and remain the property of their respective owners.
7. Service availability #
We aim to keep the site available and the contact / demo forms operational at all times, but we don't promise specific uptime levels. The site may be temporarily unavailable for maintenance, deployments, or reasons outside our control.
If a form submission fails, please retry or email us directly at the addresses listed on the contact page.
8. Liability #
We provide the marketing site and the forms it offers "as is". To the maximum extent permitted by law, we disclaim warranties beyond those mandated by law in your jurisdiction.
Our liability for any claim arising out of your use of this website is limited to the amount you have paid Quivi for marketing-website services in the 12 months preceding the claim — which is zero, since the site is free to use. This limitation does not apply to damages caused by wilful misconduct or gross negligence, or to any other liability that cannot be excluded or limited under applicable mandatory law.
9. Governing law #
These terms are governed by the laws of the United States and the state in which the contracting Quivi entity is established. Disputes that cannot be resolved informally will be heard by the courts of that jurisdiction, except where mandatory consumer-protection law in your jurisdiction grants you the right to bring proceedings locally.
10. Changes #
If we change these terms materially, we'll update the date at the top of the page. Continued use of the site after a change constitutes acceptance of the new terms.
